Terms & Conditions
Please read these terms carefully before engaging Hina App Development for any software development services.
Last updated: June 2026
1. Service Agreements
All projects undertaken by Hina App Development (the "Company") are governed by a written agreement, statement of work, or formal proposal accepted by the Client. The accepted scope, deliverables, timelines, and pricing form the binding agreement between both parties.
2. Development Process
The Company follows a structured agile development methodology including discovery, design, development, testing, and deployment phases. The Client agrees to participate in scheduled reviews, provide timely feedback, and supply the assets and approvals required to keep the project on schedule.
3. Intellectual Property Rights
Upon full payment of all project fees, the Client receives complete ownership of the final source code, designs, and deliverables produced specifically for the project. The Company retains ownership of pre-existing tools, libraries, frameworks, and methodologies used during development, including any reusable components that pre-date or are independent of the Client's engagement.
4. Project Timelines
Project timelines are estimated based on the agreed scope. Delays caused by changes in requirements, late feedback, third-party dependencies, or factors outside the Company's control may extend timelines and require schedule adjustments documented in writing.
5. Revisions & Change Requests
Each project includes a defined number of revision rounds outlined in the proposal. Additional revisions, scope changes, or feature additions beyond the agreed scope will be assessed and billed separately based on effort, complexity, and impact on the timeline.
6. Payment Terms
Projects typically follow a milestone-based payment schedule, starting with an upfront engagement fee. Invoices are payable within the period stated on each invoice (commonly 7–14 days). Late payments may incur reasonable interest charges or pause active development until cleared.
7. Confidentiality
Both parties agree to keep confidential all proprietary information, business strategies, technical specifications, and other sensitive material exchanged during the engagement. Confidentiality obligations survive the termination of the agreement.
8. Third-Party Services
Projects may rely on third-party services, APIs, libraries, hosting, or store platforms (such as Google Play Store and Apple App Store). The Client is responsible for any costs, accounts, licensing, and policy compliance associated with third-party services. The Company is not liable for outages, policy changes, or breaches by such providers.
9. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability for any claim arising from a project shall not exceed the total fees paid by the Client for that specific project. The Company shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, profits, or data.
10. Termination Policy
Either party may terminate an engagement by providing written notice. Upon termination, the Client is responsible for all work performed and approved up to the termination date. The Company will hand over deliverables completed and paid for. Refunds, if any, are limited to fees received for work not yet performed.
